Aggressive Missouri Dissolution/Divorce Attorney

Friendly divorce settlements are possible.

In order to file for a divorce in Missouri a spouse is not required to allege any ground other than "irreconcilable differences." However, the other party may claim there is no need for a divorce and therefore force the spouse wishing the divorce to prove that grounds for divorce exist. In these cases, an amicable divorce settlement is uncommon.

A spouse may go to great lengths to contest a divorce and deny that a marriage is irretrievably broken. In these cases, both spouses often hire lawyers, to help secure or contest a divorce.

At Jody Wolff & Associates, we know that aggressive representation is sometimes necessary to achieve favorable results. We understand that each situation is unique. We help our clients overcome legal obstacles by giving them a fair and comprehensive assessment of their situation. We have close to 20 years of experience in family law and an extensive network of therapists, psychiatrists, psychologists, bankers, financial counselors and other professionals who can address non-legal aspects of your case.

Our divorce/dissolution practice includes:

  • Property/asset division
  • Distribution of debt
  • Alimony/spousal maintenance
  • Child custody
  • Child support

Factors for determining Child Custody

Break-ups are painful, especially for children. Courts look at several factors in determining child custody, including: the wishes of the child, the wishes of the parents, the child's need for a meaningful relationship with each parent, interaction between parents and children, determination of which parent is more likely to allow meaningful contact with the other parent, the child's adjustment to home, school and community, mental and physical health of the people involved with the child, and a parent's intention to relocate.

What about Alimony?

In Missouri, a spouse must demonstrate a real need for alimony, or "maintenance" as it is called in this jurisdiction, before it is granted. Typically, a stay-at-home mom who gave up the opportunity for continued education in order to raise children is a good candidate for maintenance. However, even under these circumstances, it is often difficult to convince the court of the need for maintenance. Jody Wolff and Associates is committed to artful persuasion to do their best to meet a client's needs.
